The criminal procedure called "Procedimiento abreviado" in Marbella, Spain

THE VERDICT

In previous blogs we have explained all the phases of the Procedimiento Abreviado, now we are going to explain the judgment in, which is regulated in articles 785 and following of the Law of Spanish Criminal Prosecution.

Thus, once the first phase of the procedure is concluded, the hearing trial is over, the evidence is practiced, and the parties to the process and the prosecution have made the final conclusions, then, the last step in the process is for the judge to dictate the corresponding verdict.

The last phase of the “Procedimiento Abreviado”: The verdict.

The verdict will be handed down within five days after the end of the hearing trial and may not impose a heavier penalty than that requested by the accusations, nor condemn for a different crime.

These verdict handed down by the Criminal Judge is appealable before the corresponding Provincial Court (Audiencia Provincial), and that of the Central Criminal Judge (Juez Central de lo penal), before the Criminal Chamber of the National Court (Sala de lo Penal de la Audiencia Nacional.). The appeal may be filed by any of the parties, within ten days following that in which the verdict was notified.

As soon as the verdict is become as a definitive judgment (“Sentencia firme”), it will proceed to its execution by the Judge or by the Tribunal that has dictated it.

It should be said that, if the amount of compensation has not been fixed in the judgment, any of the parties may, during the execution of the sentence, urge the evidence that they deem appropriate for their precise determination.
