STATE OF LOCKDOWN by COVID-19

#StayAtHome

Due to the current situation in Spain, in which the state of lockdown by COVID-19 has been declared throughout the Spanish territory, our lawyers in Marbella offer their advice from home, teleworking.

It is not the first time that the Spanish government has used the state of lockdown tool in Spain to control a serious alteration in the country's normality. Since in 2010 the state of lockdown had to be declared to regulate the country's situation due to the closure of the airspace due to the strike of air traffic controllers.

Regulation of STATE OF LOCKDOWN by COVID-19

The present state of lockdown declared in Spain is regulated in article 116.2 of the Spanish Constitution of 1978. Also is developed in article 4 and following of chapter II of Spanish Organic Law 4/1981, of June 1, which regulates the state of lockdown. (Estado de alarma).

The state of lockdown has been declared throughout the national territory by the Spanish Government through Royal Decree-Law 8/2020, of March 17, on extraordinary urgent measures to face the economic and social impact of COVID-19, which it has been agreed in the Council of Ministers (Consejo de Ministros), having a validity of fifteen days.

The term could be extended as long as it is authorized by the Congress of Deputies (Congreso de los Diputados).
